明治12年1月24日（1879年）

是日栄一、当会議所会頭トシテ、オーストリア国領事ヨリノ依頼ニ係ル本邦商人手形ノ件ニ就キ東京府勧業課ヨリ調査ヲ依頼セラル。後日右回答書並ニ英訳文ヲ同課ニ上申ス。

御国内銀行ニ於テ普通取扱候為換証券之儀ニ付澳国領叓より別紙箇条書を以テ尋越候ニ付乍御手数急速右逐条取調御回答有之候様致度此段申入候也

　二伸　為念別紙領事より来翰之原文相添置候条御回答之節訳書一同御返却有之度候也

兼テ拙者ヨリ御問合申上候件ニ付本月二十一日附貴翰ヲ以テ御回答相成忝拝誦致シ候、然者従来日本国ニ於テハ欧米ニ公行スル為換証券類似ノ物未タ無之候ヘトモ、通常銀行ニ於テ取扱候為換法施行相成居候趣御申越就テハ左ノ箇条書ニ拠リ、右日本為換証券ノ儀御尋問申上候間御回答希上候、尤右ハ格別貴下ヲ御煩セ申上候心得ニハ無之、何卒右御尋問及ヒ候箇条書東京商法会議所或ハ府下ニ重立候銀行営業ノ者ニ御下附相成、其者ヨリ答弁ヲ得御答被下候ハヽ御手数モ相省ケ容易ノ儀ト信シ因テ此段御依頼申上候儀ニ有之候　敬具

此為換手形ニハ印税ヲ課スルヤ、若シ課スルトキハ其印税ノ価格ハ何程又是レヲ課スルノ法則ハ如何ナリヤ

為換手形ハ受取人ノ望ミニ任セ何時ニテモ即時ニ引換ヲナスモノナリヤ、又ハ定限ヲ約スルモノナリヤ

銀行ニ於テ引換ヲ取扱フニ差閊ヘナキ為換手形ハ之レニ裏書シテ他人ニ譲リ渡ス事ヲ得ヘキヤ

手形面ノ期限ニ先チ為換手形ノ引換ヲ求ムルトキハ何程ノ利子ヲ要スルヤ

仮令ハ玆ニ江戸ニ於テ請取ルヘキ百円金ノ為換証券ヲ所持セシ人アリ若シ此人是レヲ大阪・西京・長崎或ハ鹿児島等ニ於テ商人ヨリ請取ラント欲スルトキハ、右金額ニ付何程ノ手数料ヲ要スルヤ

日本国ニハ為換手形仲買商ナルモノアリヤ、若シ之レアラハ其牙銭ハ幾分ノモノナルヤ

為換手形ノ引換ヲナスヘキ時ニ払ヒヲナサヽレハ其事故ヲ証明スルノ法アリヤ

前款ノ如キ其引換ナキ為換手形ハ之レヲ受取リタル銀行ニテ如何ナル手段ヲ以テ何人ヨリ弁償ヲ受ルヤ

  Bills, namely,
  1st What is the form adopted for such Bills? Kindly furnish me with a Specimen.
  2nd Is there any stamp duly on them and, if so, what is the scale for that duty and under what law is it imposed?
  3rd Are the Bills payable at sight on demand or is any specific time stipulated for their payment?
  4th Is there any endorsment (transfer) made on the Bills if they are negotiated at one of the Banks?
  5th What rate of interest is charged at the negotiation, if the Bill is made payable at some future 15:25:32
  6th How much is deducted by the Banks for commission in negotiating cashing pay, for instance a Bill for

　　　　本邦商人手形ニ関スル御質問ニ答フ
第一
本邦ニ於テ行ハルヽ商人ノ為替手形ハ即チ別紙雛形ノ如シ、而シテ此手形ハ東京ト大阪ノ間トカ或ハ横浜ト神戸ノ間トカニ行ハルモノニシテ、其土地ニ於テ行ハルヽモノニ非ス
第二
此手形ノ印税ハ百円ニ付弐銭（即チ五千分ノ一）ノ割合ヲ以テ金高ニ応シ印紙ヲ貼用スヘキ法ナリ
第三
此手形ハ到着次第仕払フヘキモノモアレトモ、十日間位ノ期限ヲ有スルモノ多シ
第四
此手形ハ銀行ノ手ヲ経テ直チニ各宛人《（名）》ニ達スルモノナレハ、譲渡シノ裏書ヲ為ス事ナシ、但シ銀行ノ名ハ手形ノ表面ニ記載セリ
第五
手形面ノ期限ニ先チテ受取リタル金額ニ係ル利息ハ其時ノ都合ニヨリ

此手形ノ金額ヲ名宛人ニ於テ払ヒ渡サヽルトキハ、名宛人ヨリ其書面ヲ出サシムル慣習ナレトモ、若シ名宛人之ヲ肯セザルトキハ他ニ其証拠ニ立ツヘキモノナシ

前条ノ如ク其払渡シヲ拒ミタル手形ハ銀行ハ此手形ノ振出人即チ最初ノ依頼人ニ迫リテ之ヲ弁償セシムベシ

本邦ニ於テ国立銀行ハ都テ紙幣発行ノ権ヲ有ス

  Answers
  1st The Japanese merchant papers always bear the name on them of third party by which
  it is purposed to be discounted and the form are as follow;

  2nd The rate of stampduty imposd on them under Shioken Insei Kisoku (law of stampduty) is two sens per one hundred yens(2/10,000=1/5,000).
  3rd Some bills are drawn to bepay able on demand but

many others have their short specific time for payment, say, 10 days sight.
  4th It is not necessary to endorse the bills when negotiated at a Bank; because they have the name of the bank on them, by which bank they are purposed to be nego-tiated, as the specimen given above.
  5th The rate of Interest for negotiating the bills is usually 12 percent per annum though it may often vary according to the circumstances.
  6th The rate of Commission of negotiating at Tokio the bills of other cities are as follows;
  8 sens@10 sens per 100 yens. in case of the bills of
  Osake, Kioto or Kobe.
  40〟 〟50 〟 〟 〟 〟in case of the bills of
  Nagasaki or Kagoshima.
  7th There is no such person as a bill broker in Japan.
  8th If the bills duly presented are dishonored it is only customary made for the payer to take from the payer the written explanation for that reasen, but if the payer refuses even to give the explanation there is no legal proceeding for him of prot esting.
  9th In case such bills dishonored the payer (bank) can recover the value from the drawer.
  10th All the national Banks are authorised to issue paper notes to the limit authorised to each of them.
